Last updated: October 2026. This is a translation for convenience; the German version is legally binding.
1. Scope
These terms and conditions apply to all orders you place through our online shop with Mitchell Mfg. Vintage Flying Jackets UG (haftungsbeschränkt), Plessastr. 18, 52388 Nörvenich, Germany (“we”). Our contact details are in the legal notice.
A consumer is any natural person who enters into a transaction for purposes that are predominantly outside their trade, business or profession (Section 13 German Civil Code, BGB).
Made-to-measure orders are agreed in person in our showroom in Nörvenich. These terms apply to them accordingly unless we agree otherwise.
2. Customer account
To place an order you create a customer account. Please keep your login details secret. Your account shows your orders and lets you change your details. You can have your account deleted at any time; a short message to us is enough.
3. Conclusion of the contract
The presentation of products in the online shop is not a binding offer but an invitation to order.
You add the items you want to the basket and go to the checkout. There you enter your billing and delivery address, choose a payment method, can review and correct all details, and accept these terms and acknowledge the cancellation policy. By clicking “Place order” you make a binding offer to buy the items in your basket.
Immediately afterwards you receive an email confirming receipt of your order.
- Bank transfer in advance: with this email, which contains our bank details, we accept your offer and the contract is concluded.
- PayPal: the contract is concluded as soon as you complete the payment with PayPal.
The contract language is German; orders placed on the English site can also be handled in English. We store the contract text. Your order details are always available in your customer account, these terms on this page.
4. Size details
So that your jacket fits, please give your height, weight and chest measurement in the comment field of your order. Measuring instructions and the measurements of each model are in the size charts on the product pages. If a detail is unclear or does not match the size ordered, we contact you before production.
5. Prices and shipping costs
All prices are final prices including statutory VAT. The price shown at the time of ordering applies. Shipping costs are added; they are shown in the basket and before you complete your order.
6. Payment
The available payment methods are shown at the checkout:
- Bank transfer in advance: you transfer the invoice amount to the account we give you in the order confirmation. Please use the order number as the payment reference. Payment is due within 7 days of the conclusion of the contract. We start production as soon as payment has been received.
- PayPal: you pay through your PayPal account. PayPal’s own terms also apply.
If you are in default of payment, the statutory rules apply.
7. Delivery
We deliver with DHL to the delivery address you give, within the European Union. The countries we deliver to and the shipping costs for each are shown at the checkout.
Every jacket is made by hand after you order it. Delivery therefore takes about 3 to 4 weeks after receipt of payment, unless the product page says otherwise. When your order is ready to ship, you receive an email with the tracking number.
If a delivery cannot be made due to force majeure, we inform you without delay and refund any payments already made immediately.
8. Retention of title
The goods remain our property until they have been paid for in full.
9. Right of withdrawal
As a consumer you have a right of withdrawal. The details are in our cancellation policy.
We bear the regular costs of returning the goods. If possible, please use the return label we send you on request and the original packaging. Neither is a condition of your withdrawal.
There is no right of withdrawal for goods made to your personal measurements (Section 312g (2) No. 1 BGB), i.e. made-to-measure orders. Jackets in the standard sizes offered can be returned like any other goods.
10. Liability for defects
The statutory rights for defects apply. The limitation period for claims for defects is two years from delivery.
Our jackets are made of leather, a natural material. Differences in colour, grain and texture between two jackets and compared with the product photographs are part of the material and make every jacket unique.
Please report obvious transport damage to the carrier and to us as soon as possible. Your statutory rights do not depend on this; it helps us pursue our claims against the carrier.
11. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and where we have given a guarantee.
In the event of a slightly negligent breach of an obligation that is essential for achieving the purpose of the contract and on whose fulfilment you may regularly rely (cardinal obligation), our liability is limited to the foreseeable damage typical of the contract. Otherwise, liability for slight negligence is excluded.
12. Applicable law and place of jurisdiction
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, the mandatory consumer protection provisions of the country in which you have your habitual residence remain unaffected.
If you are a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from this contract is our registered office in Nörvenich.
13. Dispute resolution
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
